This was the action brought by the plaintiff to recover damages for a malicious prosecution instituted by the defendant. - The damages were laid at £1000.
The declaration in this action contained two counts. The 1st set forth that the defendant on the 17th day of November last, at Parramatta, went before Mr. James M'Arthur, one of his Majesty's Justices of the Peace for the colony, and charged plaintiff with having feloniously killed and slayed an ox, the property of said defendant.
